These Terms of Use (“Terms”) govern your access to and use of hermoneysolutions.com and related webpages or subdomains (collectively, the “Website”), owned and operated by Her Money Solutions, LLC (“Her Money Solutions,” “we,” “us,” or “our”). By using the Website, you agree to these Terms and the policies incorporated by reference below.

1. ABOUT HER MONEY SOLUTIONS, LLC

Her Money Solutions provides financial education, information, resources, speaking services, consultations, and related products and services. Her Money Solutions, LLC is separate from Delfau Tax & Financial Services, LLC (“DT&FS”). Tax preparation, tax representation, and other tax professional services provided through DT&FS are governed by separate engagement agreements. 2. USE OF THE WEBSITE

You may use the Website only for lawful purposes and in accordance with these Terms. You may not use the Website:

• in violation of applicable law or regulation;
• to infringe another person’s intellectual property, privacy, publicity, or other rights;
• to transmit malicious software or harmful material, interfere with Website security or operation, or attempt unauthorized access;
• to impersonate another person or entity, collect information about users without authorization, or engage in fraudulent or harmful activity.

We may restrict or terminate access if we reasonably believe these Terms have been materially violated.

3. AGE AND CAPACITY

The Website is intended for a general audience and may contain educational information useful to teenagers as well as adults. It is not directed to children under 13. If you are under the age legally required to enter a binding contract in your jurisdiction, you may not make a purchase or enter an agreement with Her Money Solutions without the involvement and consent of a parent or legal guardian. 4. EDUCATIONAL CONTENT AND PROFESSIONAL RELATIONSHIPS

Website content is provided for educational and informational purposes and is subject to our Disclaimer & Disclosures. Use of the Website, by itself, does not create a tax professional-client, attorney-client, investment adviser-client, or other professional-client relationship. Any professional engagement must be expressly established for the applicable service.

5. FREE AND DOWNLOADABLE RESOURCES

Unless otherwise stated, Her Money Solutions grants you a limited, revocable, non-exclusive, non-transferable license to use free or paid worksheets, checklists, guides, templates, and other downloadable resources (“Resources”) for personal use or internal business use. You may download and print reasonable copies for that permitted use.

Except as permitted by law or with written permission, you may not sell, sublicense, redistribute, commercially reproduce, publicly post, remove proprietary notices from, claim as your own, or create and sell a substantially similar product derived from a Resource. Nothing here prevents lawful discussion, review, criticism, or commentary.

6. INTELLECTUAL PROPERTY

The Website and its original content, including text, graphics, logos, photographs, videos, audio, downloads, worksheets, guides, designs, and presentations, are owned by or licensed to Her Money Solutions and protected by applicable intellectual-property laws. Use of the Website does not transfer ownership to you. Except as expressly permitted by these Terms or applicable law, you may not reproduce, republish, sell, distribute, modify, publicly display, commercially exploit, or create derivative works from protected content without prior written permission.

7. AUTOMATED ACCESS, SCRAPING, AND AI USE

You may not use bots, scrapers, crawlers, data-mining tools, or similar technologies to systematically extract or reproduce substantial portions of proprietary Her Money Solutions content in violation of applicable law or these Terms. You may not use paid, gated, downloadable, or otherwise proprietary Her Money Solutions materials to create, train, develop, or commercialize a substantially similar or competing product, course, publication, database, or service without written permission. This does not prohibit lawful search-engine indexing, ordinary personal use of generally available technology, lawful quotation or commentary, or uses that cannot lawfully be restricted.

8. USER COMMUNICATIONS AND FEEDBACK

If you contact us, you represent that information you provide is accurate to the best of your knowledge and that you have the right to provide it. We may consider and use voluntary ideas, suggestions, or general feedback to improve our business without compensation. Providing feedback does not automatically grant us the right to use your name, photograph, personal story, testimonial, copyrighted work, or other identifiable content for marketing. Where appropriate, we will obtain permission before using identifiable material for promotional purposes.

9. THIRD-PARTY WEBSITES AND SERVICES

The Website may link to third-party websites, products, services, tools, or resources. Unless expressly stated otherwise, a link does not mean Her Money Solutions endorses, controls, or is affiliated with the third party. Our Privacy Policy describes how we collect, use, disclose, retain, and protect personal information and is incorporated into these Terms by reference.

11. WEBSITE AVAILABILITY AND SECURITY

We make reasonable efforts to maintain the Website but do not guarantee uninterrupted, secure, or error-free access. The Website may be unavailable due to maintenance, technical issues, third-party interruptions, security issues, or circumstances beyond our control. We cannot guarantee that the Website or downloadable files will always be free of harmful components; you are responsible for using appropriate safeguards.

12. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. HER MONEY SOLUTIONS DISCLAIMS WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THE OPERATION, AVAILABILITY, ACCURACY, COMPLETENESS, RELIABILITY, SECURITY, OR SUITABILITY OF THE WEBSITE OR CONTENT FOR A PARTICULAR PURPOSE. Some jurisdictions do not allow certain exclusions, so some may not apply to you.

13. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, HER MONEY SOLUTIONS, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO USE OF, OR INABILITY TO USE, THE WEBSITE OR ITS CONTENT. TO THE FULLEST EXTENT PERMITTED BY LAW, TOTAL LIABILITY ARISING OUT OF OR RELATING TO YOUR USE OF THE WEBSITE WILL NOT EXCEED THE AMOUNT, IF ANY, YOU PAID DIRECTLY TO HER MONEY SOLUTIONS FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS PRECEDING THE EVENT. Any limitation applies only to the extent permitted by applicable law.

14. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Her Money Solutions, LLC and its owners, officers, employees, contractors, and agents from third-party claims, liabilities, damages, judgments, costs, and reasonable attorneys’ fees arising from your unlawful use of the Website, material violation of these Terms, or infringement of another party’s rights. We may control the defense of a matter subject to indemnification, and you agree to reasonably cooperate.

15. CHANGES

We may modify the Website or these Terms from time to time. Material revisions will be reflected in the “Last Updated” date. Continued use after revised Terms become effective constitutes acceptance to the extent permitted by law.

16. GOVERNING LAW, JURISDICTION, AND MEDIATION

These Terms are governed by Florida law, without regard to conflict-of-law principles. To the extent permitted by law, legal proceedings arising from these Terms or Website use shall be brought exclusively in an appropriate state or federal court having jurisdiction in Pinellas County, Florida, and you consent to jurisdiction and venue there. Before litigation, the parties agree to make a good-faith effort to resolve the dispute informally and, if unresolved, to attempt mediation, except where emergency or injunctive relief is reasonably necessary or applicable law provides otherwise. Nothing here deprives a consumer of a non-waivable right or remedy.

17. SEVERABILITY, NO WAIVER, AND ENTIRE AGREEMENT

If a provision is invalid or unenforceable, it will be enforced to the fullest extent permitted and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, Disclaimer & Disclosures, and any applicable Terms of Purchase or product-specific agreement, govern Website use. Product- or service-specific terms control a transaction to the extent they conflict with these general Terms.

These Terms of Purchase (“Purchase Terms”) apply to products and services purchased directly from Her Money Solutions, LLC. By completing a purchase, you agree to these Purchase Terms and the Terms of Use, Privacy Policy, and Disclaimer & Disclosures, each incorporated by reference. Product-specific terms presented on a sales page, booking page, checkout page, proposal, or written agreement control that purchase to the extent they conflict with these general Purchase Terms.

1. SCOPE AND DT&FS SEPARATION

These Purchase Terms do not govern tax preparation, tax representation, or other tax professional services provided through Delfau Tax & Financial Services, LLC. Those services are governed by separate engagement agreements. Purchasing a Her Money Solutions product or service does not automatically establish a tax professional-client relationship with Kristin Delfau, EA or DT&FS. See our Disclaimer & Disclosures for additional information about the scope of Her Money Solutions services.

2. ELIGIBILITY TO PURCHASE

You must have legal capacity to enter a binding agreement. If you have not reached the age of legal capacity in your jurisdiction, a parent or legal guardian must make or authorize the purchase on your behalf.

3. PRODUCTS, SERVICES, PRICING, AND PAYMENT

Her Money Solutions may offer consultations, digital downloads, worksheets, guides, templates, books, courses, workshops, webinars, speaking engagements, and other products or services. Material terms such as description, price, delivery method, and included materials will be provided on the applicable sales, booking, checkout, proposal, or agreement page. Prices are in U.S. dollars unless stated otherwise. You agree to pay the disclosed price plus applicable taxes, shipping, or other charges shown before purchase. Prices may change prospectively.

We may correct obvious pricing or description errors. If an error affects a completed order, we may offer you the option to proceed under corrected terms or cancel and receive a refund of the amount paid.

4. ORDER CONFIRMATION AND FULFILLMENT

Online purchases generally generate an electronic confirmation or receipt. If you do not receive confirmation or access information within a reasonable period, contact hello@hermoneysolutions.com. We may cancel an order because of fraud, payment failure, obvious error, unavailability, or another legitimate reason. If we cancel a paid order we cannot fulfill, we will refund the applicable amount.

5. DIGITAL PRODUCTS AND LICENSE

Unless a sales page states otherwise, purchase of a digital product grants a limited, revocable, non-exclusive, non-transferable license for personal use or internal business use. You may not sell, redistribute, share purchased access with unauthorized users, commercially reproduce or publicly post the product, remove proprietary notices, claim it as your own, or use substantial portions to create and sell a substantially similar or competing commercial product. Ownership and other intellectual-property rights remain with Her Money Solutions and are also governed by the Terms of Use.

6. CONSULTATIONS

The length, scope, price, and purpose of a Her Money Solutions consultation will be described at booking. Consultations may involve discussion of your individual circumstances, but the nature and limits of the service remain governed by the applicable service description and our Disclaimer & Disclosures. Unless expressly agreed otherwise in writing, a consultation does not include tax-return preparation or filing, representation before a taxing authority, legal representation, investment management or securities transactions, or another professional service requiring a separate engagement.

Rescheduling and Cancellation

The cancellation and rescheduling policy displayed when you book is incorporated into these Purchase Terms. Consultation fees are non-refundable once the consultation has occurred unless otherwise required by law. Before the appointment, refund, credit, rescheduling, and no-show consequences are governed by the policy disclosed at booking.

7. DIGITAL PRODUCT REFUNDS

Because digital products can generally be accessed, downloaded, or copied after delivery, purchases are final and non-refundable once access or delivery occurs, except where the applicable sales page states otherwise, the product is materially defective and we cannot provide a reasonable remedy, or applicable law requires a refund. Contact us if you experience a technical access problem so we can attempt to resolve it.

8. COURSES, WORKSHOPS, AND PROGRAMS

A course, workshop, webinar, cohort, or other educational program may have program-specific cancellation and refund terms. Those terms control if they conflict with these Purchase Terms. Unless otherwise stated at purchase, commencement of a program or delivery of substantial digital program materials may limit refund eligibility to the extent permitted by law.

9. BOOKS AND PHYSICAL PRODUCTS

Books or physical products sold directly by Her Money Solutions are subject to shipping, return, and refund terms disclosed at purchase. For purchases from an independent retailer, bookseller, marketplace, event organizer, or other seller, that seller’s policies govern and Her Money Solutions does not administer its returns or refunds.

10. SPEAKING ENGAGEMENTS AND CUSTOM SERVICES

Speaking engagements, organizational workshops, custom presentations, and other contracted services may be governed by a separate proposal, speaker agreement, contract, or statement of work. That written agreement controls if it conflicts with these Purchase Terms.

11. REFUNDS GENERALLY

Except as otherwise stated in these Purchase Terms, on the applicable sales or checkout page, in a written agreement, or as required by law, sales are final after the applicable product or service has been delivered. Nothing here limits a consumer right that cannot legally be waived. Approved refunds may be subject to processing times of the payment processor and financial institution.

12. PAYMENT DISPUTES AND CHARGEBACKS

If you believe a charge is incorrect, please contact hello@hermoneysolutions.com so we can investigate. Nothing here prevents you from exercising a lawful right to dispute a transaction with your financial institution. We may respond to a chargeback and provide relevant transaction, delivery, communication, and refund-policy records. Fraudulent payment use or knowingly false disputes may result in termination of access and other remedies permitted by law.

13. EDUCATIONAL NATURE, WARRANTIES, LIABILITY, AND DISPUTES

Her Money Solutions products and services are subject to our Disclaimer & Disclosures, including its provisions concerning educational purpose, professional relationships, accuracy, and results. The warranty, limitation-of-liability, governing-law, jurisdiction, venue, and mediation provisions in our Terms of Use apply to purchases governed by these Purchase Terms to the fullest extent permitted by law. Nothing in these Purchase Terms excludes a liability or consumer right that cannot legally be excluded or limited.

14. THIRD-PARTY PAYMENT AND DELIVERY SERVICES

We may use third-party providers to process payments, schedule appointments, deliver digital products, host courses, or fulfill products. Those services may have their own terms and privacy practices. Our handling of personal information is described in the Privacy Policy. We are not responsible for delays caused solely by third parties outside our reasonable control, but we will make reasonable efforts to assist with problems involving purchases made directly from Her Money Solutions.

15. REFUSAL OR TERMINATION OF SERVICE

We may refuse or terminate a transaction or service when reasonably necessary because of fraud, unlawful activity, harassment, abuse, threats, material violations of these Purchase Terms, nonpayment, or circumstances making continued service unreasonable or unsafe. If we terminate for reasons unrelated to your conduct after receiving payment for services not provided, we will refund the appropriate unearned amount. Other refund eligibility depends on applicable terms and law.

16. CHANGES AND CONTACT

We may update these Purchase Terms prospectively. Terms applicable to a completed transaction will generally be those presented or applicable when the transaction occurred, together with later changes you expressly accept or that applicable law permits.
